WINFIELD — A former resident is suing Teays Valley Center, and Genesis Healthcare, alleging negligence and insufficient measures taken to prevent injuries.

Linda G. Wiggins filed a complaint on Aug. 16 in Putnam Circuit Court against 590 North Poplar Fork Road Operations LLC, d/b/a Teays Valley Center, and Genesis Healthcare LLC, alleging it failed to provide a safe environment to live in.

According to the complaint, the plaintiff alleges that between from Sept. 18-26, 2015, she was under the care of Teays Valley Center to receive care and treatment. During her residency, she suffered from a fall resulting in a neck fracture that required surgical intervention, she alleges, also claiming that she suffered abuse and neglect, mental anguish, pain and suffering and medical expenses. The plaintiff holds the defendants responsible because they allegedly failed to properly monitor and assess her condition, failed to implement a plan of care and treatment to prevent her from falling and failed to provide adequate and appropriate nursing care.

The plaintiff requests a trial by jury and seeks judgment against the defendants for all damages, attorneys' fees, costs as well as other items that the court sees fit to award. She is represented by Andrew L. Paternostro, Jeff D. Stewart and Shayla M. Rigsby of The Bell Law Firm PLLC in Charleston.
