Property owners blame subdivision, contractor for flooding

LOGAN — Logan County property owners are suing a political subdivision and a contractor, alleging their negligence caused flood damage to their home.

Philip Hatfield and Kathy Hatfield filed a lawsuit Sept. 2 in Logan Circuit Court against the Logan County Public Service District and E. L. Robinson Engineering Co., alleging negligent design and approval of a new septic system.

According to the complaint, the Hatfields incurred damages, including flooding in their basement, costs of connection to the septic system, damage to their lawn at Lot 603 Parkview sudivision in Holden, plus annoyance and inconvenience. The plaintiffs allege the defendants failed to take into consideration the Hatfields' existing septic line and caused their septic connection to be moved from the front of the Hatfield home to a new connection on the rear.

The Hatfields seek trial by jury, judgment in an amount to fully compensate their damages, costs of action, pre-and post-judgment interest and all other relief. They are represented by attorney Robert B. Kuenzel of Kuenzel & Associates PLLC in Chapmanville.
