Nursing home resident blames facility for injuries

BECKLEY — A nursing home resident is suing a Beckley nursing home and its staff, alleging negligence in failing to prevent injuries.

Arlene Toler, on behalf of Rose Mary White, filed a lawsuit Sept. 7 in Raleigh Circuit Court against Jackie Withrow Hospital, administrator Angela Booker, John Does 1-10 and unidentified entities 1-10, alleging violation of the Nursing Home Reform Act.

According to the complaint, during White's residency at the nursing home from Nov. 10, 2010 to the present, she has suffered numerous injuries, disfigurement, pain, suffering and mental anguish. 

The plaintiff alleges the defendants have failed to adequately and timely assess and treat White's pressure sores and infection and have failed to develop and implement appropriate resident care plan.

Toler and White seek trial by jury, all compensatory damages, plus court costs and all other relief to which White is entitled. They are represented by attorney Michael J. Fuller of McHugh Fuller Law Group PLLC in Hattiesburg, Mississippi.
