WHEELING — A Triadelphia car owner is suing Hartford Insurance and an Ohio County body shop, alleging breach of contract regarding an insurance claim.

Karen Harrigan filed a lawsuit Sept. 14 in Ohio Circuit Court against Hartford Insurance Company of the Midwest and Gary's Body Shop Inc. in Wheeling, alleging they failed to comply with the laws and regulations relating to the handling of insurance claims.

According to the complaint, despite rental coverage provided by Hartford, and despite the cause of delays on Harrigan's car when it remained in Gary's custody, she was billed by the car rental company for $1,077.51.

The plaintiff alleges Hartford failed to attempt to resolve her claim for the repair of her car and breached its duty of good faith and fair dealing. The suit says Gary's allowed Hartford to influence and dictate the manner of repairing Harrigan's car.

Harrigan seeks trial by jury, judgment, jointly and severally, for compensatory damages, punitive damages, attorney fees and court costs, plus any other relief. She is represented by attorneys Anthony I. Werner of John & Werner Law Offices PLLC in Wheeling, and by Jeffrey A. Grove of Grove Holmstrand & Delk PLLC in Wheeling.
