CHARLESTON — A 59-year-old Randolph County man is suing the West Virginia Department of Agriculture, alleging age discrimination and wrongful termination.

Marvin Warner filed a lawsuit Aug. 30 in Kanawha Circuit Court against the West Virginia Department of Agriculture, alleging violation of the West Virginia Human Rights Act.

According to the complaint, after 35 years of employment with the department, Warner was terminated from June 30, 2015, because of his age. The suit says Warner has suffered and will continue to suffer lost wages and benefits, indignity, embarrassment, humiliation and inconvenience in an amount to be determined at trial. 

The plaintiff alleges the defendant unlawfully terminated his employment.

Warner seeks trial by jury, compensation for all damages, pre-judgment interest, attorney fees, court costs and all other relief. He is represented by attorneys Mark A. Atkinson and John-Mark Atkinson of Atkinson & Polak PLLC in Charleston.
