BECKLEY — A West Virginia grocery items distributor is suing a Raleigh County food store and a Cabell County man, alleging they owe nearly $12,000 for breach of contract.
The H.T. Hackney Co. filed a lawsuit Sept. 15 in Raleigh Circuit Court against
D-N-J Food Store Inc. and Daniel Eugene Rider,
alleging failure to comply with its contractual obligations.
According to the complaint, in November 2015, H.T. Hackney sold and delivered goods and services to D-N-J Food Store in the amount of $11,836.20 without receiving any payment. The plaintiff alleges the defendants have failed to pay for the products services and equipment purchased H.T. Hackney.
H.T. Hackney seeks trial by jury, judgment, jointly and severally, for $11,836.20, plus pre- and post-judgment interest, attorney fees, court costs and any further relief. It is represented by attorney Ryan S. Marsteller of Bailes, Craig & Yon PLLC in Huntington.
