CHARLESTON — A disabled Kanawha County woman is suing Prudential Insurance and another company, alleging breach of contract, discrimination, negligence and retaliation.

Starlena G. Goff filed a lawsuit May 13 in Kanawha Circuit Court against Frontier Communications of America Inc. and Prudential Insurance Company of America, alleging they breached their duties of good faith and fair dealing.

According to the complaint, Goff purchased an insurance policy from Prudential when she became disabled. The suit says Prudential covered only a small portion of her disability, while her former employer, Frontier Communications, cut her pay, benefits and hours once she became disabled and eventually terminated her employment. 

As a result of defendants' actions, the lawsuit states, Goff has suffered emotional distress, pain and suffering, mental anguish, embarrassment, lost wages and benefits. 

The plaintiff alleges the defendants violated common law in reviewing the plaintiff's claim and offered an unfair/delayed settlement to Goff, failed to provide short-term and long-term disability benefits to employees, and discriminated against the plaintiff by terminating her employment based on disability and age.

Goff seeks trial by jury, benefits of the policy, court costs, attorney fees and other relief the court deems available. She is represented by attorneys D. Adrian Hoosier and Erica Lord of Lord Hoosier PLLC in Charleston.
