Couple blames private, public entities for property damage

WINFIELD — A Putnam County couple is suing private and public county entity, alleging breach of contract in damaging the plaintiffs' property.

James and Janeene Nida of Scott Depot filed a lawsuit Sept. 22 in Putnam Circuit Court against Mike Enyart & Sons Inc. and Putnam Public Service District, alleging breaching the terms of their agreement.

According to the complaint, in 2014, James and Janeene Nida entered a contractual agreement with Enyart for reclamation activities and improvements to their property in Scott Depot involving new sanitary sewer lines. 

As a result of defendants' breach of contract, the suit says, the Nidas suffered damages of more than $26,000, plus consequential damages. The plaintiffs allege the defendants caused significant property damages while installing the sewer lines and that the Putnam Public Service District has failed and refuses to pay for damaging the plaintiffs' property.

The Nidas seeks trial by jury, compensation for taking and/or damaging the plaintiffs' property, court costs and attorney fees. They are represented by attorney Thomas H. Peyton of Peyton Law Firm PLLC in Nitro.
