Financial business alleges tire company owes nearly $75,000

WINFIELD — A financial institution is suing a Putnam County tire business, alleging it owes nearly $75,000.

CAN Capital Asset Services Inc., formerly known as Newlogic Business Loans Inc., filed a lawsuit Oct. 3 in Putnam Circuit Court against Diana J. Smith, doing business as Eddie's Tire Pros, alleging failure to comply with its obligations under the business loan agreement.

According to the complaint, on July 28, 2015, CAN Capital entered into a business loan agreement and issued a loan to Eddie's Tire Pros. The balance account of $74,843.50 remains uncollected, the suit says. 

CAN Capital Asset Services seeks trial by jury, judgment of $74,843.50, plus post-judgment interest and costs. It is represented by attorneys Paul J. Atkins, James B. Adkins and Bree Whipp Ogle of Atkins Ogle Law Office LC in Buffalo.
