Employee accuses physician's office operator of wrongful termination

HUNTINGTON — A Cabell County woman is suing a physician's office operator, alleging retaliation and wrongful termination.

Janet L. Fields filed a lawsuit Sept. 27 in Cabell Circuit Court against University Physicians and Surgeons Inc., alleging the defendant interfered with her rights under the Family Medical Leave Act.

According to the complaint, on Sept. 14, 2014, Fields' mother was diagnosed with breast cancer. After the diagnosis, the suit says, Fields needed to take time off work to provide care and support for her mother. 

The lawsuit states on Sept. 29, 2014, Fields was discharged from her employment. The plaintiff alleges the defendant retaliated against her for exercising her rights and engaging in protected conduct and terminated her employment for she took FMLA leave and posted her position as vacant within an hour after her discharge.

Fields seeks trial by jury, compensatory, actual and punitive damages, pre- and post-judgment interest, attorney fees and court costs and all other relief the court deems fair. She is represented by attorney B. Luke Styer of Huntington.
