Hardware store alleges quarry operators owe nearly $23,000

KEYSER — A Keyser hardware store is suing the operators of an Elk Garden quarry, alleging breach of contract in failing to pay nearly $23,000.

Boggs Supply Inc. filed a lawsuit Oct. 5 in Mineral Circuit Court against Allemari Stone LLC, Dennis Allen and Thomas Amari, alleging the defendants failed to comply with their open account agreement.

According to the complaint, between November 2011 and November 2014, Boggs Supply provided various merchandise and services to the defendants for which there remains an unpaid balance of $22,994.66. 

The plaintiff alleges despite several attempts to collect the debt, the defendants have failed and refused to respond and, as of the filing of this complaint, Allemari Stone, Allen and Amari remain indebted to the plaintiff and have not tendered any payments.

Boggs Supply seeks trial by jury, judgment, jointly and severally, in the principal amount of $22,994.66, pre- and post-judgment interest, legal fees, costs for this action and all other relief. It is represented by attorney John D. Athey of Keyser.
