LOGAN – A Logan County man alleges he is legally blind and his vision loss could have been avoided had he received proper care at an emergency room.

David Dale Stevens Jr. filed a complaint on Oct. 6 in the Logan Circuit Court against Health Care Alliance Inc., Logan General Hospital LLC and Dr. Beena Nagpal alleging medical malpractice and negligence.

According to the complaint, the plaintiff alleges that he repeatedly returned to defendant Logan Regional Medical Center's emergency department in 2014 for complaints of pain in the left occipital area and left base of the skull, but he was not properly diagnosed with papilledema and acute vision loss. He alleges he is now legally blind and is totally disabled. The plaintiff holds Health Care Alliance Inc., Logan General Hospital LLC and Nagpal responsible because defendant Nagpal allegedly failed to perform physical examination, failed to order proper diagnostic testing and failed to refer him to an ophthalmologist.

The plaintiff requests a trial by jury and seeks judgment against defendants in such sums that will adequately compensate him for his injuries, together with pre- and post-judgment interest, cost expended for the lawsuit, attorney's fees and for such other and further relief. He is represented by William M. Tiano of Taino O'Dell PLLC in Charleston. The case has been assigned to Circuit Judge Eric H. O'Briant.
