Hayes Contractors Inc. alleges it is owed more than $14,000 in back rent from individual

KEYSER – A Ridgeley corporation alleges a tenant owes back rent on a property.

Hayes Contractors Inc. filed a complaint on Oct. 25 in the Mineral Circuit Court against BMEC Inc. and Brian Moreland alleging breach of contract.

According to the complaint, the plaintiff alleges that it entered into an oral agreement in April 2015 where defendants would purchase its real property for $180,000 and a monthly rent of $1,000 until the sale would be finalized. The plaintiff holds BMEC Inc. and Moreland responsible because the defendants allegedly occupied and took possession of plaintiff's improved real estate, failed to pay monthly rent and interfered with plaintiff's business relationship. As a result of defendant's actions, it alleges suffered damages from losing the ability to both lease and sell the demised real estate.

The plaintiff requests a trial by jury and seeks judgment against defendants in the amount of $14,000 for back rent and $180,000 for breach of contract of sale, to have right to re-enter the premises, an order ejecting defendants from the premises, attorney's fees and costs for this action and all other equitable relief.
