CHARLESTON – A Kanawha County woman alleges she was injured by a cable in an alley while jogging.

Regan S. McGahan filed a complaint Nov. 4 in Kanawha Circuit Court against Patrick T. Gates, Capitol Partners LLC, Neyer Commercial Realty LLC and John Doe, alleging premises liability and negligence.

According to the complaint, on Nov. 11, 2014, McGahan was jogging through an alley in downtown Charleston when she tripped and fell over an unmarked and nearly invisible cable that the defendants owned. She alleges she sustained injuries resulting in pain and suffering, annoyance, loss of income and incurred medical bills. The plaintiff alleges the defendants failed to protect her from and/or to warn her of the dangerous condition.

McGahan seeks trial by jury, compensatory and punitive damages, pre- and post-judgment interest, attorney fees and court costs and all other relief. She is represented by attorneys Tony N. Giatras and Matthew Stonestreet of The Giatras Law Firm PLLC in Charleston. The case has been assigned to Circuit Judge James C. Stucky.
