Morgantown company alleges Beckley business owes more than $8,000

BECKLEY — A Morgantown company is suing a Beckley business, alleging failure to pay more than $8,000 for purchased products and unjust enrichment.

CWS Division of Swanson Industries filed a lawsuit Nov. 9 in Raleigh Circuit Court against Phillips Machine Service Inc., through its wholly owned subsidiary The Combs Group Inc. alleging failure to perform its contractual obligations.

According to the complaint, CWS Division sold certain goods to the defendant in the amount of $8,183.30. The plaintiff alleges the defendant has not paid and/ or returned the goods bought from the plaintiff.

CWS Division of Swanson Industries seeks trial by jury, judgment for $8,183.30, plus interest at the statutory rate of 7 percent per annum from Aug. 12, costs of suit and all other relief. It is represented by attorney John R. Keating of Amato Keating and Lessa PC in Bethlehem, Pennsylvania.
