Deutsche Bank accused of unjust enrichment

KEYSER — A West Virginia man is suing Deutsche Bank, alleging unjust enrichment.

Keith Leo Johnson filed a lawsuit Nov. 23, in the Mineral Circuit Court against Deutsche Bank Trust Company Americas, alleging improperly foreclosing property in Keyser.

According to the complaint, Johnson entered into a modification agreement with Deutsche Bank to modify a loan and continue paying the indebtedness. The suit says the agreement was unilaterally revoked and the Keyser property proceeded into foreclosure causing Johnson to suffer monetary damages. 

The plaintiff alleges Deutsche Bank proceeded with the foreclosure without Johnson's and purchased the property at less than half the fair market value.

Johnson seeks trial by jury, judgment enjoining defendant from selling the property, declaring the foreclosure null and void, giving plaintiff reasonable time to satisfy the indebtedness, damages of $55,000, punitive damages of $250,000, costs of court and all other just relief.
