WHEELING – An estate administrator is suing a Wheeling nursing home, alleging the defendant's negligence led to the death of the plaintiff's mother.
Margaret Hutchison, administrator of the estate of Nancy Quesenberry, filed a lawsuit Nov. 28 in Ohio Circuit Court against Guardian Elder Care at Wheeling LLC, doing business as Peterson Rehabilitation Hospital and Geriatric Center alleging violation of the West Virginia Nursing Home Act.
According to the complaint, during Quesenberry's readmission at Peterson Rehabilitation in 2015, her pressure ulcer deteriorated and worsened. The suit says before her death Jan. 4, 2016, Quesenberry suffered physical pain, mental anguish and incurred medical bills.
The plaintiff alleges the defendants failed to allow Quesenberry to receive the highest physical, mental and psychological well-being, failed to develop an appropriate care plan and failed to provide services that met professional standards of care.
Hutchison seeks trial by jury, judgment for an amount that will fairly compensate her for all damages resulting from defendant's conduct, court costs, expenses and fees and all other proper relief. She is represented by attorney Geoffrey C. Brown of Bordas & Bordas PLLC in Wheeling. The case has been assigned to Circuit Judge David J. Sims.
