WHEELING — A customer is suing a Wheeling car dealer and lender, alleging breach of implied and express warranties.
Robert M. Wilson filed a lawsuit Dec. 1 in Ohio Circuit Court against
FCA US LLC, Constantin Motors Inc. and Ally Financial Inc.,
alleging they violated the Lemon Law and the Consumer Credit Protection Act.
According to the complaint, on June 20, 2015, Wilson purchased a 2015 Dodge Ram pickup truck for $52,087.84 from the defendant. After purchase, the suit says, the pickup truck was defective in materials and workmanship, which substantially impaired its use, safety and value.
The plaintiff alleges the defendants failed to perform necessary repairs to conform with the warranties and failed to replace the defective vehicle that conforms to the warranties.
Wilson seeks trial by jury, revocation of acceptance and the return of the purchase price and other expenses, punitive damages, cost of litigation and all other available relief. He is represented by attorney Ronald William Kasserman of Kasserman Law Offices PLLC in Wheeling.
