Wood County couple alleges Lumber Liquidators misrepresented product

CHARLESTON — A Wood County couple is suing Virginia hardwood flooring companies, alleging the defendants' negligence exposed the defendants to toxic fumes. 

Thomas Balderson and Barbara Balderson filed a lawsuit Dec. 1 in Kanawha Circuit Court against Lumber Liquidators Holdings Inc., Lumber Liquidators Leasing LLC and Lumber Liquidators Services LLC of Toano, Virginia, alleging misrepresentation of the safety and effectiveness of the defendants' products.

According to the complaint, the Baldersons, as a result of defendants' omissions, were exposed to toxic gases and fumes that caused injuries to their bodies, including their internal organs. The Baldersons had purchased more than 1,200 feet of laminate floor covering Aug. 3, 2013, from the defendants store in Nitro, West Virginia, the suit says. 

The plaintiffs allege the defendants failed and refused to provide adequate warnings and instructions associated with the use of their flooring products, which contain high level of formaldehyde, a toxic chemical.

The Baldersons seeks trial by jury, compensatory and punitive damages, attorney fees and costs, pre and post-judgment interest and all other proper relief. They are represented by attorney Marvin W. Masters of The Masters Law Firm LC in Charleston.
