Two consumer allege Nissan violated warranties

BECKLEY — An Oak Hill couple is suing Nissan, alleging breach of express and implied warranties.

Michael and Bernadine Sizemore filed a lawsuit Dec. 13 in Raleigh Circuit Court against Nissan North America Inc., alleging repeated violation of the West Virginia Code.

According to the complaint, on July 16, 2014, Michael and Bernadine Sizemore purchased a new 2014 Nissan Murano Cross Cab for $42,560. After purchase, the suit says, the plaintiffs experienced defects with the vehicle, and these defects substantially impaired the vehicle's value, use and safety. 

The plaintiffs allege Nissan North America failed to repair the vehicle in a good and workmanlike manner so as to bring it in conformity with its warranties.

The Sizemores seeks trial by jury, revocation of acceptance and refund of the purchase price, costs of repairs and all other consequential expenses, attorney fees and costs of action, plus all other appropriate relief. They are represented by attorney Anthony M. Salvatore of Hewitt & Salvatore PLLC in Beckley.
