BECKLEY — A West Virginia woman is suing a Pennsylvania debt collector, alleging unfair and unconscionable collection practices.

Lisa Bennett filed a class action complaint individually and on behalf of all others similarly situated in Raleigh Circuit Court against Tate & Kirlin Associates Inc. of Philadelphia, alleging violation of the West Virginia Consumer Credit Protection Act.

According to the complaint, on Dec. 30, 2014, Bennett received a collection letter that was beyond the time limitations for filing a legal action. The plaintiff alleges the defendant attempted to collect a time-barred debt and failed to provide disclosures as required by the WVCCPA.

Bennett seeks trial by jury, an order enjoining the defendant from attempting to collect time-barred debts, attorney fees and costs of court, plus all other appropriate relief. She is represented by attorneys Ralph C. Young, Christopher B. Frost, Steven R. Broadwater Jr. and Jed R. Nolan of Hamilton, Burgess, Young & Pollard PLLC in Fayetteville.
