Huntington medical facility operators blamed for resident's injuries

HUNTINGTON — A Mingo County woman is suing Huntington medical facility operators, alleging negligence in that insufficient measures were taken to prevent injuries.

Denise Jude, as power of attorney of Marie Copley, filed a lawsuit Dec. 9 in Cabell Circuit Court against Rebound LLC, doing business as Healthsouth Rehabilitation Hospital of Huntington and HealthSouth Corporation, alleging the defendant breached its duty to provide adequate and appropriate health care services.

According to the complaint, during Copley's residency at defendants' medical facility, Healthsouth of Huntington from April 14-16, 2016, she sustained bodily injuries resulting in pain and suffering, mental anguish, aggravation and physical defects from a broken right arm suffered in a fall. 

The plaintiff alleges the defendants failed to provide adequate supervision, assessment and assistance to Copley and failed to provide proper safety devices to prevent her from falling.

Jude seeks trial by jury, all damages allowable by law, attorney fees, court costs and all other equitable relief. She is represented by attorneys Andrew L. Paternostro, Jeff D. Stewart and Shayla M. Rigsby of The Bell Law Firm PLLC in Charleston.
