MOUNDSVILLE – Property owners claim mining under the property and around it done by The Marshall County Coal Co. has damaged the property.
Terry E. Evans, Stevin R. Evans and Gregory C. Evans filed a complaint on Dec. 22 in Marshall Circuit Court against The Marshall County Coal Co. alleging that the mining operator violated the Surface Coal Mining and Reclamation Control Act.
According to the complaint, the plaintiffs allege that in 2015, as a result of defendant's long-wall mining, plaintiffs began to notice damages to their Cameron property, including but not limited to damages to their buildings and fixtures, loss of natural water resources and loss of use of structures and properties. The plaintiffs hold The Marshall County Coal Co. responsible because the defendant allegedly failed to correct and or compensate plaintiffs' damages.
The plaintiffs request a trial by jury and seek judgment against defendant in an amount sufficient to compensate them for their damages, pre- and post-judgment interest, attorney's fees and costs and such other just and proper relief.
