MORGANTOWN – A Monongalia County woman is suing Elite Learning & Social Center after she claims it failed to pay her final pay after she quit.

Ashley Hines was tired in August by the defendant and voluntarily resigned from her hospital on Sept. 21, according to a complaint filed in Monongalia Circuit Court.

Hines claims normal and customary channel for receiving her pay was to pick up a handwritten check at the defendant’s business location in Monongalia County and she was paid every other Friday.

The defendant did not pay Hines her wages earned from Sept. 10 through Sept. 21 on or before the next regular payday on which those wages would otherwise be due and payable, according to the suit.

Hines claims the defendant has still never paid her final wages.

The defendant violated the West Virginia Wage Payment and Collection Act, according to the suit.

Hines is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Phillip Estep, Todd S. Bailess and Rodney A. Smith of Bailess Smith PLLC.
