WINFIELD — A Putnam County analytical service provider is suing a mining operator, alleging alleged breach of agreement and unjust enrichment in failing to pay for services rendered.
Ma Inc., formerly known as Bio-Chem Testing Inc. filed complaint Jan. 9 in Putnam Circuit Court against ERP Compliant Fuels LLC, alleging failure to fulfill its contractual obligations.
According to the complaint, in 2016, Ma Inc. plaintiff provided water testing services to ERP in the amount of $22,678.65, As a result of the defendant's breach, the suit says, Ma Inc. sustained economic damages of $22,678,65, together with collection costs, attorney fees and inconvenience.
The plaintiff alleges ERP Compliant Fuels, despite repeated requests for payment, has failed and refused to make payments for Ma's services performed.
Ma Inc. seeks trial by jury, judgment in an amount that will fully and fairly compensate the plaintiff's damages, attorney fees, court costs, pre and post-judgment interest and all other appropriate relief.
