Employee blames CSX for injuries

WINFIELD — A Poca man is suing CSX Transportation, alleging the defendant's negligence led to injuries for the plaintiff. 

William D. Hilton filed a complaint Jan. 12 in Putnam Circuit Court against CSX Transportation Inc., alleging the defendant negligently subjected him to risks of injury.

According to the complaint, as a result of CSX's negligence, between July 2008 and June 2015, Hilton sustained severe and permanent repetitive motion injuries to his hands and arms, resulting in physical and mental pain, disfigurement, lost wages and medical expenses. 

The plaintiff alleges CSX Transportation subjected him to the risks of severe injury to his upper extremities, without properly maintained equipment, without proper rest periods and with increased quotas and less manpower.

Hilton seeks trial by jury, judgment in an amount that will fairly compensate for his injuries, pre- and post-judgment interest, plus costs of court. He is represented by attorney Harvey D. Peyton of Peyton Law Firm PLLC in Nitro.
