Delivery man blames rental homes operators for injuries

CHARLESTON — A Kanawha County man is suing Charleston rental homes operators, alleging insufficient measures were taken to prevent injuries.

Rodney D. Johnson Jr. filed a lawsuit Jan. 13 in Kanawha Circuit Court against Bailey Land LLC and Currey and Associates LLC, alleging negligence in breaching their duty to maintain their premises in a safe condition.

According to the complaint, on July 30, 2016, Johnson was delivering pizza to a Charleston rental home owned and operated by the defendants. After he delivered pizza to one of the defendants' tenants, and as he was coming down the wooden stairs, the suit says, Johnson's left leg fell through a step causing him to sustain serious injuries.

The lawsuit states Johnson suffered economic and non-economic damages, medical expenses and physical and mental pain. The plaintiff alleges the defendants negligently allowed the wooden stairs to remain in state of disrepair and failed to warn lawful invitees that the stairs were dangerous.

Johnson seeks trial by jury, judgment in an amount to be proven at trial, together with interest, attorney fees, court costs and expenses and all other just and proper relief. He is represented by attorney Russell A. Williams of Pritt Spano & Williams PLLC in Charleston.
