CHARLESTON — A former Tygert Center at Fairmont resident is suing health care providers, citing alleged insufficient measures were taken to prevent injuries.
Tom Taylor filed a complaint Jan. 13 in Kanawha Circuit Court against
Genesis Healthcare LLC, 1539 Country Club Road Operating LLC, et al, alleging they failed to discharge their obligations of care.
According to the complaint, Taylor alleges that, between April 30, 2014, and Oct. 9, 2015, while he was a resident at the defendants' skilled nursing facility, he sustained catastrophic injuries and suffered mental anguish, extreme pain and suffering. He holds the defendants responsible because they allegedly failed to properly manage, operate and control their nursing home facility and failed to take corrective actions when operational problems were brought to their attention.
Taylor requests a trial by jury and seeks judgment against the defendants for damages to be determined at trial and in an amount in excess of the jurisdictional limits of the court, costs of litigation and such other relief he may be entitled.
