Designer accuses former employer of age discrimination

CHARLESTON — A Jackson County man is suing his former employer, alleging age and disability discrimination.

Frank Brown filed a complaint Jan. 24 in he Kanawha Circuit Court against Jacobs PSG Inc. alleging violation of the West Virginia Human Rights Act and the West Virginia Wage Payment and Collection Act.

According to the complaint, on Sept. 6, 2016, Brown was informed by his physician that he has cancer and would need time off for surgery and treatment. The next day, the suit says, after Brown's supervisor learned of his medical condition, Brown was terminated from his employment at Jacobs PSG. 

Due to the defendant's actions, the plaintiff says he has suffered lost wages and benefits, emotional and mental distress, aggravation and inconvenience. The plaintiff alleges Jacobs PSG failed to provide reasonable accommodations, terminated his employment because of his cancer diagnosis, replaced him with a younger employee with no medical problems and failed to pay his final wages after his discharge.

Brown seeks trial by jury, compensatory damages, liquidated damages twice the amount of the owed wages, back pay, reinstatement or front pay, litigation costs and all other appropriate relief.
