Granddaughter blames nursing home operators for grandmother's death

CHARLESTON — A Monongalia County woman is suing Kanawha County nursing home facility operators, alleging their negligence led to her grandmother's death.

Alicia Kalka, as personal representative of the estate of Betty Lawson, filed a complaint Jan. 26 in Kanawha Circuit Court against 1 Sutphin Drive Operations LLC, doing business as Marmet Center, and Genesis Healthcare LLC, alleging they breached their duty to ensure that decedent Betty Lawson will be free from abuse, neglect and mistreatment.

According to the complaint, beginning Feb. 24, 2016, Lawson was a resident of Marmet Center. During her residency, she suffered falls, serious injuries and infection, resulting in pain and suffering, mental anguish, and incurred medical treatment. She died on April 1, 2016, the suit says. 

Kalka says she suffered funeral expenses, mental pain, loss of companionship and the service of her grandmother. The plaintiff alleges the defendants failed to provide an environment free of hazards, and failed to provide adequate supervisions and assistance devices to prevent accidents.

Kalka seeks trial by jury, all damages allowable by law, punitive damages, attorney fees and all other equitable relief. She is represented by attorneys Andrew L. Paternostro, Jeff D. Stewart and Shayla M. Rigsby of The Bell Law Firm PLLC in Charleston.
