HUNTINGTON — A lessee is suing Ellis & Ellis PLC, a property management agent, citing alleged fraudulent and deceptive representation.
Brandon Price filed a complaint on Jan. 27 in the Cabell Circuit Court against Ellis & Ellis PLC alleging that the company refused to withdraw a wrongful occupation petition.
According to the complaint, the plaintiff alleges that on Jan. 16, 2015, he leased an apartment from Spruce Manor Inc. Pursuant to the terms of HUD program, the plaintiff was required to pay only a portion of the monthly rent. On Nov. 21, the plaintiff received a notice to vacate the premises for not paying his rent for four months in the amount of $608. The plaintiff holds Ellis & Ellis responsible because the defendant allegedly refused to allow the plaintiff an opportunity to review his file and refused to withdraw the petition voluntarily.
The plaintiff requests a trial by jury and seeks damages in excess of the minimum jurisdictional limits of the court, and such other just and proper relief. He is represented by J. William St. Clair of Legal Aid of West Virginia in Huntington.
