WAYNE — An Ohio man invitee is suing an elevator company, alleging its negligence led to injuries for the plaintiff.
Scott Douglas Williamson of Lawrence County, Ohio, filed a complaint Feb. 16 in Wayne County Circuit Court against Murphy Elevator Company Inc. of Louisville, alleging violation of the West Virginia Elevator Safety Act.
According to the complaint, on March 10, 2015, while visiting the Veterans Affairs Hospital in Wayne County, Williamson was crossing through the doors of the elevator frame when the doors malfunctioned. The suit says the doors suddenly closed, hitting Williamson's head and body, causing him to fall forward into the cab. As a result, the lawsuit states, he suffered head and body injuries.
The plaintiff alleges Murphy Elevator failed to properly maintain its client's elevator sensors and mechanisms and failed to post any warnings or take any steps to protect the hospital's visitors from being hurt.
Williamson seeks trial by jury, damages for personal injuries, medical expenses, pain and suffering, pre- and post-judgment interest and other damages that exceed the minimum jurisdiction of the court.
