Son blames health care facility for mother's death

CHARLESTON — A Kanawha County man is suing operators of a Charleston nursing facility, alleging reckless misconduct and wrongful death.

Gary Sloan, as personal representative of the estate of Willia Sloan, filed a complaint Feb. 13 in Kanawha Circuit Court against 1000 Lincoln Drive Operations LLC, doing business as  Valley Center Genesis Healthcare LLC, alleging failure to provide quality care and a safe environment to his mother as required by law.

According to the complaint, on June 5, 2015, Willia Sloan was admitted at Valley Center for rehabilitation and assistance with her activities of daily living. During her residency, the suit says, she suffered from systematic abuse and neglect, causing significant injuries, and leading to or contributing to her death July 4, 2016. 

The plaintiff alleges Valley Center failed to keep Sloan's family fully informed of her total health status and medical condition, failed to properly staff the facility, failed to provide proper supervision to residents and failed to maintain premises in a safe and secure manner.

Gary Sloan seeks trial by jury, all damages allowable under West Virginia law, attorney fees, and punitive damages and all other proper relief. He is represented by attorneys Andrew L. Paternostro, Jeff D. Steward and Shayla M. Rigsby of The Bell Law Firm, PLLC in Charleston.
