Daughter blames health care providers for mother's death

CHARLESTON — A Logan woman is suing Logan County health care providers, alleging their negligence led to the death of her mother. 

Coral Neal, as personal representative of the estate of Ernestine Kirk, filed a complaint Feb. 13 in Kanawha Circuit Court against Three Mile Curve Operations LLC, oing business as Logan Center and Genesis Healthcare LLC, alleging they breached their mandated duty to protect Kirk's nursing home resident's rights.

According to the complaint, starting Dec. 30, 2015, Kirk was a resident at Logan Center. During her residency, the suit says, the defendants negligently failed to provide adequate supervision to prevent her from accidental fall Jan. 24, 2016. The lawsuit states Kirk sustained serious injuries that ultimately lead to her untimely death May 16, 2016. 

The plaintiff alleges the defendants failed to ensure that Kirk was free from abuse, neglect and mistreatment and failed to provide an environment free of accident hazards.

Neal seeks trial by jury, actual and punitive damages, litigation costs and all other appropriate relief. She is represented by attorneys Andrew L. Paternostro, Jeff D. Stewart and Shayla M. Rigsby of The Bell Law Firm PLLC in Charleston.
