CHARLESTON — West Virginia is suing Kwik Lube, alleging violation of state law.
The state of West Virginia er rel. Offices of the West Virginia Insurance Commissioner, filed a complaint Feb. 17 in Kanawha Circuit Court against James D. Randolph, doing business as a Kwik Lube, alleging violation of the laws of the Offices of the Insurance Commissioner.
According to the complaint, Kwik Lube's conduct caused irreparable harm to the plaintiff, other employees and claimants served by the state as well as local taxpayers. The plaintiff alleges Kwik Lube failed to obtain and/or maintain workers compensation insurance coverage with a private carrier.
The state of West Virginia seeks trial by jury, an order enjoining the defendants from doing business in West Virginia until all fines and penalties are satisfied and to obtain worker's compensation coverage, award for costs of court. It is represented by attorney David Ansell of the Office of the Insurance Commissioner Legal Services Division in Charleston.
