Fazoli's employee alleges restaurant, insurer failed to pay proper benefits

HUNTINGTON — A Kentucky woman is suing a restaurant group and claims administrators, alleging violation of workers compensation acts.

Lori Thomas of Clark County, Kentucky, filed a complaint on Feb. 22 in the U.S. District Court for the Southern District of West Virginia against Life Insurance Co. of North America, Fazoli's Restaurant Group Inc., LTD Plan and Does 1-10, alleging that they violated the Employee Retirement Income Security Act.

According to the complaint, as a result of defendants' refusal to pay Thomas' claim for long-term disability benefits, she has suffered damages and will incur attorney fees and costs. 

The plaintiff alleges the defendants repeatedly denied her appeal for additional LTD benefits after a failed attempt to return to work through the defendants' vocational rehabilitation program.

Thomas seeks trial by jury, an order for Life Insurance of North America to pay the plaintiff all benefits due under the plan, interest, attorney fees and court costs and all other legal and equitable relief. She is represented by attorney J. Patrick L. Stephens of Underwood Law Offices in Huntington.
