Wetzel County couple says doctor deviated from medical care standards

WHEELING — A Wetzel County couple is suing medical care providers, citing alleged insufficient measures were taken to prevent injuries.

Gary L. Tennant and Kimberly J. Tennant filed a complaint on Feb. 23 in the Ohio Circuit Court against Dr. Kim Steven Wiley and Ohio Valley Colon and Rectal Surgeons PLLC, alleging that they breached and deviated from the applicable standards of medical care.

According to the complaint, the plaintiffs allege that as a result of Wiley's breach and deviation, Gary Tennant sustained a continued leakage of his small bowel and the development of an enterocutaneous fistula and was deprived of a chance of an eventual recovery. Kimberly Tennant suffered loss of consortium and service of her husband. The plaintiffs hold the defendants responsible because Wiley allegedly failed to perform segmental resection at the site of the leakage, prior to suturing and closing.

The plaintiffs request a trial by jury and seek judgment against the defendants, jointly and severally, to compensate them for their injuries and damages, plus interest, and such other relief. They are represented by J. Michael Benninger of Benninger Law PLLC in Morgantown.
