Gas station customer sues over cut foot

LOGAN — A customer is suing Speedway LLC, alleging that insufficient measures were taken to prevent injuries at the gas station.

Ronnie Cooper filed a complaint March 2 in Logan Circuit Court against the gas station, alleging that the station failed to properly maintain the business premises to avoid accidents.

According to the complaint, the plaintiff alleges he was a customer at the gas station when the plaintiff attempted to pump gas. Cooper cut his foot on a piece of metal protuding from the base of the gas pump, the complaint said. The injury on his foot caused him to suffer pain, seek medical attention and incur medical expenses, according to the complaint.

The plaintiff holds Speedway LLC responsible because the defendant allegedly failed to regularly check the gas pump for defects, failed to warn the plaintiff of the dangerous condition of gas pump and failed to maintain the gas pump and business premises in general on a timely basis.

The plaintiff requests a trial by jury and seeks judgment in an amount that will fully and fairly compensate the plaintiff for his injuries and damages, plus the cost of the court action, prejudgment interest and other further relief the court deems proper. He is represented by Donald C. Wandling of Wandling Law Office in Logan.
