WINFIELD — Two Putnam County homeowners are suing a Hurricane construction company, alleging breach of warranty.
Eugene H. Beaver and Karan F. Beaver filed a complaint March 9 in Putnam Circuit Court against Crouch Construction LLC, alleging negligence in violation of the International Residential Code.
According to the complaint, on Nov. 24, 2014, the Beavers contracted Crouch for the construction of their new home in Putnam County. However, the suit says, it was later discovered that the house had numerous construction defects and the plaintiffs describe the defendant's behavior as "atrocious and intolerable."
The lawsuit states the Beavers have suffered inconvenience, aggravation and annoyance. The plaintiffs allege Crouch Construction failed to comply with the applicable building code requirements and refused to rectify the construction defects.
The Beavers seek trial by jury, compensatory, punitive and incidental damages, interest, court costs and expenses and all other just and proper relief. They are represented by attorney Robert H. Miller II of The Sutter Law Firm PLLC in Charleston.
