CHARLESTON — The daughter of a deceased patient is suing Kanawha County health care providers, alleging breach of fiduciary duty.
Patricia White, executor of the estate of Howard Hendricks, filed a complaint March 16 in Kanawha Circuit Court against
Clark's Christian Care Inc., Rebekah Clark and Leonard Clark,
alleging failure to protect White's father from financial exploitation.
According to the complaint, Hendricks gave $30,000 to Rebekah and Leonard Clark under the auspices of a loan that would be paid back by discounting the costs of care provided to him. As a result, the suit says, White and Hendricks were damaged financially when the defendants took advantage of Hendricks' physical and mental infirmities and unlawfully conspired to deprive him of his personal property rights.
White seeks trial by jury, compensatory and punitive damages, interest, costs and expenses and all other appropriate relief. She is represented by attorneys Brian L. Ooten and K. Brian Adkins of Shaffer & Shaffer PLLC in Madison.
