David Ellis was also named as a defendant in the suit.
On Feb. 5, 2009, Devco applied for and was issued a revolving line of credit for a power plan account, according to a complaint filed March 23 in Mingo Circuit Court.
John Deere claims Devco has not made a payment in the account since Oct. 16, 2013.
As of Dec. 16, 2013, a balance of $6,748.95 remains due and owing to the plaintiff as a result of Devco’s failure to make payments on the account, according to the suit.
John Deere claims Devco’s account is accruing interest at the rate of 11.90 percent per annum in the amount of $2,578.80 from Dec. 16, 2013, through March 2.
Devco breached its contract with John Deere and was unjustly enriched at John Deere’s expense, according to the suit.
John Deere is seeking judgment in the amount of $9,327.75 with continuing interest. It is being represented by Arch W. Riley Jr. of Bernstein-Burkley PC.
