Medical malpractice 09

WAYNE — An estate administrator is suing a Huntington medical care provider, alleging breach of duty.

Dale Crabtree of Wayne County, as administrator of the estate of Ruth Eleanor Thompson, filed a complaint March 15 in Wayne Circuit Court against Infinity PLLC, alleging the defendant breached its duty to provide medical records when requested.

According to the complaint, Ruth Eleanor Thompson was a patient of Infinity at the time of or near her death. After the plaintiff's appointment as Thompson's administrator, the suit says, Crabtree requested copies of the decedent's medical records.

To date his request has not been granted, the lawsuit states, as Infinity has refused to produce copies of the requested records.

Crabtree seeks trial by jury, an order requiring the defendant to produce all records in its possession related to the treatment of Thompson, damages, attorney fees, court costs and all other just and proper relief. He is represented by attorney Scott D. Maddox of Maddox Law Office PLLC in Huntington.
