Property owners allege mining company violated agreement

CHARLESTON — Four Kanawha County property owners are suing a mining company, alleging breach of a settlement agreement and unjust enrichment.

Denver Davis, Donna Sue Davis, Gary Shaffer and Patti Lee Shaffer filed a complaint March 7 in Kanawha Circuit Court against Viking Energy Corporation, alleging the defendant willfully violated the arbitration order and settlement agreement.

According to the complaint, in 2015 the parties entered into a settlement agreement that obligates Viking Energy to pay the plaintiffs $50,000 to plug a gas production well on the plaintiffs' property. To date, the plaintiffs say they have yet to receive this amount. 

The plaintiffs allege Viking Energy has failed and refuses to pay as agreed and continues to inject waste onto the plaintiffs' property.

The plaintiffs seek trial by jury , enforcement of the settlement agreement, including judgment of $50,000 and damages, plus interest and all just and proper relief. They are represented by attorneys Isak Howell and Joseph M. Lovett of Appalachian Mountain Advocates in Lewisburg.
