WHEELING — A Wheeling man is suing a mortgage loan servicer and holder, alleging illegal debt collection.
James C. Bradley filed a complaint April 17 in Ohio Circuit Court against Shellpoint Mortgage Servicing and Bank of New York Mellon, as trustee for the certificate holders CWABS Inc.,alleging violation of the West Virginia Consumer Credit and Protection Act.
According to the complaint, as a result of the defendants' actions, Bradley has been damaged monetarily. The plaintiff alleges the defendants refused to accept his payments, failed to credit him for amounts paid and continuously assessed additional fees to his account.
Bradley seeks trial by jury, actual damages, attorney fees, costs of court and all just and equitable relief. He is represented by attorneys Colten L. Fleu of Mountain State Justice Inc. in Charleston and Michael Nissim-Sabat of Mountain State Justice in Clarksburg.
