LOGAN — A Chapmanville woman is suing a medical center, alleging constructive discharge due to her pregnancy.

Cindesta Hensley filed a complaint April 21 in Logan Circuit Court against the Logan Regional Medical Center and Willie Viars, alleging violation of the West Virginia Human Rights Act.

According to the complaint, as a result of the defendants' discriminatory actions, Hensley, who was pregnant, was forced to quit her job. The suit says Hensley was caused to suffer financial hardship, lost wages and benefits, emotional distress and anxiety. 

The plaintiff alleges the defendants subjected her to disparate treatment by failing to hire her to a full-time position for which she was qualified and available during her pregnancy.

Hensley seeks trial by jury, compensatory damages, pre- and post-judgment interest, attorney fees and court costs and all other just and proper relief. She is represented by attorneys Erika Klie Kolenich and Karl Kolenich of Klie Law Offices PLLC in Buckhannon.
