WILLIAMSON — A successor by merger is suing a Gilbert mining company, alleging breach of a credit agreement.
Jenmar Corporation, successor by merger to DSI Underground Systems Inc., filed a complaint April 24 in Mingo Circuit Court against Selah Corporation, alleging failure to fulfill its obligation under the terms of the agreement.
According to the complaint, Jenmar provided Selah a line of credit to purchase mining equipment at a fair and reasonable price. As of June 29, 2016, the suit says, the balance of $122,033.65 remains due and owing to Jenmar.
The plaintiff alleges Selah Corporation has failed to pay for the mining equipment purchased from the plaintiff.
Jenmar seeks trial by jury, judgment of $158,339.49, plus continuing interest and costs of court. It is represented by attorney Arch W. Riley Jr. of Bernstein-Burkley PC in Wheeling.
