Huntington contractor alleges property owners owe more than $1,600

WINFIELD — A Huntington contractor is suing Putnam County property owners, alleging breach of contract.

Tri-State Paving & Sealcoatinng LLC, doing business as Mozack Concrete, filed a complaint April 27 in Putnam Circuit Court against Good Ol'Boy's Trucking & Repair LLC, James A. Kuhn, Paula A. Kuhn, The West Virginia Housing Development Fund and Otis L. O'Connor, alleging they failed to perform their contractual obligations.

According to the complaint, on July 19, 2016, Mozack Concrete provided materials and labor for the completion of the paving and seal-coating work at the Kuhns' property in Hurricane. To date, the amount of $1,627.10 remains unpaid, the suit says. 

The plaintiff alleges the defendants have failed and refused to pay for the material and services provided by plaintiff.

Mozack Concrete seeks trial by jury, damages that will fully compensate the plaintiff's losses, plus interest, attorney fees, court costs and all just and proper relief. It is represented by attorneys Perry W. Oxley and Laci B. Browning of Anspach Meeks Ellenberger LLP in Huntington.
