Sales associate blames Sherwin-Williams for head injuries

BECKLEY — A Fayette County woman is suing Sherwin-Williams, alleging its negligence led to her head injury.

Mercedes Newkirk of Beards Folk filed a complaint April 28 in Raleigh Circuit Court against The Sherwin-Williams Company and Jane Doe Inc., alleging they breached their duty to provide a safe place to work.

According to the complaint, on May 1, 2015, Newkirk was in the course and scope of her employment with Sherwin-Williams at the company's store in Beckely when she sustained injuries when her head hit the forks of a forklift, 

The plaintiff says she experienced pain and suffering, lost wages and medical-related expenses. She alleges the defendants failed to operate and park the forklift in a safe and prudent manner.

Newkirk seeks trial by jury, compensatory and punitive damages, pre- and post-judgment interest, attorney fees and court costs and all other equitable relief. She is represented by attorney Brian L. Ooten of Shaffer & Shaffer PLLC in Madison.
