CHARLESTON — A West Virginia corporation has filed a class action lawsuit against a Maryland company, alleging unlawful advertising.
E&G Inc. filed a complaint, individually and on behalf of all others similarly situated, filed a complaint May 5 in the U.S. District Court for the Southern District of West Virginia against SemaConnect Inc. and John Does 1-5, alleging that they violated the Junk Fax Prevention Act.
According to the complaint, E&G was damaged for losing the use of its fax machine, paper and ink toner. because the defendants sent facsimile transmissions of unsolicited advertisements without prior express invitation or permission.
E&G seeks trial by jury, an order allowing the case be properly maintained as a class action, appointing the plaintiff as representative of the class and its counsel as class counsel, damages, interest, costs and all other relief.
