WHEELING — Two couples and their children are suing a tractor trailer owner and driver, alleging their negligence led to a crash that injured the plaintiffs.
Kasee Porter, David Porter, Samuel Porter, Jeremy Porter, Pamela Lipscomb and David Lipscomb filed a complaint May 11 in Ohio Circuit Court against Sandeep Badwalsigh and Indy Freight Inc., alleging Indy Freight negligently maintained its truck and Badwalsigh drove carelessly,
According to the complaint, on March 13, 2016, Kasee Porter was operating her vehicle in which Pamela Lipscomb was a passenger on Interstate Highway 70 in Ohio County. The suit says Badwalsigh, carelessly operating an Indy Freight truck, struck the plaintiffs' vehicle.
The lawsuit states Porter and Lipscomb sustained injuries resulting in pain and suffering and medical expenses. The four other plaintiffs allege they suffered loss of service and consortium of both injured plaintiffs.
The plaintiffs allege Badwalsigh recklessly disregarded public's safety and drove the tractor-trailer in excess of a safe speed for the existing conditions.
The plaintiffs seek trial by jury, compensatory and punitive damages, plus interest, costs of court and legal fees and all other just and proper relief. They are represented by attorney Joseph J. John of John & Werner Law Offices PLLC in Wheeling.
